General conditions of sale and delivery

Scope

These general conditions of sale and delivery apply to all sales concluded between GBM FRANCE and professional buyers. These conditions prevail over any clauses that may appear on the documents of these buyers. Thus, any order for products implies the unconditional acceptance by the buyer of our present general conditions of sale and delivery.

Orders

The customer, by confirming the order, acknowledges having read and accepted our general conditions of sale.
The minimum order is set at 50 € HT, for any lower order, 10 € management fees will be required.
For the first order, the buyer must complete the account opening form.
After each order an acknowledgment will be systematically sent.
GBM FRANCE cannot be held responsible for the abusive or fraudulent use by natural or legal persons who have had access to the customer’s identification data.
In the event of non-payment, incorrect address or other problems related to the order, GBM reserves the right to block the latter until the situation is resolved.

Price

Our prices are in Euros, excluding taxes, departure from our stores, Franco Metropolitan France from € 150.00 excluding VAT. The pricing conditions are subject to change without notice.

Packaging

Standard packaging included. Specific packaging, sea or air: on consultation.

Delivery

For metropolitan France if the order is less than 150 € a flat rate shipping of 15 € Ht is fixed.
For Corsica, the French overseas departments and territories and other countries, as well as for coastal maritime transport, transport costs will be recalculated according to the rates in force. GBM France will calculate the amount of transport costs according to your order, its proposal must be validated by the customer.

Delivery delay

Deliveries are made to the address indicated on the order form, items that will not be available will be shipped as soon as available.
Same day dispatch with order before 12 o’clock.
Deliveries outside mainland France are possible, transport costs will be recalculated according to the weight of the order and the place of delivery.
The risks are the responsibility of the purchaser, the purchaser must check the goods upon receipt, in the event of damage the customer must make his reservations known to the carrier within a maximum period of 3 days by registered mail.
If the delivery times exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Payment

Several choices possible
By credit card, by SSL (Secure Socket Layer) system: the information is encrypted and secured using the SSL protocol, so that third parties cannot read the information communicated.

Buyers, non-professional natural persons, benefit from a withdrawal period of seven days from the delivery of their order to return the product to the seller for exchange or refund without penalty, with the exception of return costs. Professionals will be subject to a 20% penalty with a minimum amount of € 15 excluding tax. The return costs will be borne by the buyer.

Return

No return of material will be accepted without the written consent of GBM FRANCE. The parts that have been used are not taken back under any circumstances. Any accepted return will be postage paid unless otherwise agreed in writing by GBM FRANCE. A reduction of 20% will be applied on the amount excluding tax of the goods accepted and returned.

Retention of title

We reserve title to the goods delivered until full payment of the corresponding invoice and any additional costs, if any. The buyer will be responsible for the risks in the event of loss, theft, damage or destruction between departure from our stores and full payment for the goods.

Jurisdiction

The jurisdiction of the commercial court of our head office is the only one competent to resolve any dispute of any kind, even in the event of a warranty call.
In the event of an international transaction, French law is the only applicable one and the court of our commercial seat is the only one competent.

Data protection

All data relating to the purchaser resulting from commercial relations with GBM FRANCE are processed in accordance with the provisions of the Data Protection Act.

General

Texts and photos are not contractual. The photographs representing the products offered are given for information only. All texts and images presented on the site are reserved, for the whole world, under copyright and intellectual property rights.
Our responsibility is limited exclusively to the simple exchange of any parts recognized as defective, no other compensation can be requested from us for damages and for any reason whatsoever.

These general conditions of sale are applicable without reservation to all orders entrusted to our Company.
The sales contract is only perfect after acceptance by the seller of the buyer’s order. Matters handled by our agents only engage us after written ratification from us. These general conditions cancel all other general purchasing conditions.

Management of personal data

All information concerning bank cards remains confidential and entered only on our bank’s website at the time of payment.
GBM FRANCE will never know your card number and confidential code.
All data recorded on our site will never be sold or distributed to third parties.
